1. Acceptance and Business Identity
These Terms & Conditions govern your use of LeadSynx and its marketing services and marketing technology. LeadSynx is a DBA of ELEV8LIFEGROUP LLC (“LeadSynx,” “we,” “us,” or “our”). By using the website or engaging our services, you agree to these Terms and our Privacy Policy.
Eligibility and Age Requirement. The LeadSynx website, services and messaging programs are intended for businesses and for individuals who are at least 18 years of age. By using the website, engaging our services or opting into any LeadSynx SMS program, you confirm that you are 18 years of age or older. LeadSynx does not knowingly provide services to, or send messages to, individuals under 18.
2. Services
LeadSynx may provide digital marketing, campaign management, marketing automation, CRM technology and integrations, customer engagement, SMS and email marketing infrastructure, appointment automation, analytics, workflow technology, APIs and webhooks. The scope, timing and deliverables for an engagement are defined in the applicable proposal, order or service agreement.
3. Pricing and Payment
Pricing varies depending on services, campaign requirements, integrations, usage and customization. Applicable charges, billing terms and taxes will be communicated before services begin or in the applicable agreement.
4. Customer Responsibilities
You agree to provide accurate information, protect account credentials where applicable, use the services lawfully and obtain all permissions required for communications and information you direct LeadSynx systems to process. You remain responsible for the content of your campaigns and compliance obligations specific to your business.
5. SMS Messaging Terms
Program. LeadSynx may send marketing and/or non-marketing SMS communications to users who have affirmatively opted into the applicable messaging program. Marketing messages may include special offers, promotions, marketing updates and service information. Non-marketing messages may concern customer service, account notifications, appointment information and service-related communications.
Consent. Users may voluntarily provide consent through the LeadSynx website by selecting the appropriate SMS consent checkbox. Marketing and non-marketing choices are separate and optional. Providing a phone number, submitting a form or accepting these Terms or the Privacy Policy does not provide SMS consent. Consent to receive marketing messages is not a condition of purchase.
Message Frequency. Message frequency may vary based on the messaging program and the user’s interactions with LeadSynx, up to approximately 4 messages per month.
Message & Data Rates. Message and data rates may apply.
Age Requirement. SMS participation is limited to individuals who are at least 18 years of age. By opting in, the user confirms they are 18 or older.
Opt-Out. Users may opt out of SMS communications at any time by replying STOP (text STOP) to any message from the applicable program. After opting out, the user will no longer receive messages from the applicable SMS program except where permitted or required to confirm the opt-out.

Carrier Disclaimer. Wireless carriers are not liable for delayed or undelivered messages.
Privacy. SMS communications and mobile information are handled according to the LeadSynx Privacy Policy.
6. Acceptable Use
You may not misuse the website or services, attempt unauthorized access, interfere with security, transmit unlawful content or use LeadSynx technology in violation of applicable marketing, privacy or communications laws.
7. Intellectual Property
The LeadSynx name, website, software, designs and original content are owned by ELEV8LIFEGROUP LLC or its licensors. No ownership rights are transferred except as expressly stated in a written agreement.
8. Third-Party Services and Integrations
Services may connect with third-party CRM, scheduling, analytics, advertising, email, messaging or automation platforms. Those services are governed by their own terms and availability. LeadSynx is not responsible for changes or interruptions controlled by third parties.
9. Disclaimers
Services are provided subject to the terms of the applicable agreement. Marketing outcomes depend on many factors outside LeadSynx’s control, and no specific result is guaranteed unless expressly stated in writing.
10. Limitation of Liability
To the fullest extent permitted by law, ELEV8LIFEGROUP LLC DBA LeadSynx will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of the website or services. Any limitations in a separate signed agreement will govern that engagement.
11. Changes and Termination
We may update these Terms by posting a revised version with a new effective date. We may suspend access to protect security, comply with law or address material violations.
12. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, unless a separate written agreement states otherwise.
